Registration
In consideration of your use of the Service, you represent that you are of legal age to form a binding contract. If you provide any information that is untrue, inaccurate, not current or incomplete, or if Prepped has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Prepped has the right to suspend or terminate your account and refuse any and all current or future use of the Service. Prepped is concerned about the safety and privacy of all its users, particularly children. For this reason, parents or guardians of children under the age of 13 who wish to allow their children access to the Service must create an account that is maintained by a legal guardian of at least 18 years old and monitor the child’s usage. By allowing a child access to your account, you also give your child permission to access all areas of the Service.
Member Accounts
If you choose to register you will receive a username and password upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Prepped of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Prepped cannot and will not be liable for any loss or damage arising from your failure to protect your account. You acknowledge, consent and agree that Prepped may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of Prepped, its users and the public.
Limited License
You may access and view the content on the Site on your computer or other internet compatible device, and make single copies or prints of the content on the Site for your personal, internal use only. The Site and the services offered on or through the Site, including any content and materials thereon, are only for your personal, non-commercial use. Purchased products are available for nine months from the date of purchase.
Prohibited Use
Any commercial distribution, publishing or exploitation of the Site, or any content, code, data or materials on the Site, is strictly prohibited unless you have received the express prior permission of Prepped or the applicable rights holder. You may not otherwise download, display, copy, reproduce, distribute, modify, perform, transfer, create derivative works from, sell or otherwise exploit any content, code, data or materials on the Site. If you make other use of the Site, or the content, code, data or materials thereon, except as otherwise provided above, you may violate copyright and other laws of the United States, other countries, as well as applicable state laws and may be subject to liability for such unauthorized use. Prepped will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

Prepped makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Prepped does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
Limitations
In no event shall Prepped or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, not getting accepted to schools,) arising out of the use or inability to use the materials on Prepped’s Internet site, even if Prepped authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Termination
You agree that Prepped may, under certain circumstances and without prior notice, immediately terminate your Prepped account, any associated email address, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) engagement by you in fraudulent or illegal activities, and/or (g) nonpayment of any fees owed by you in connection with the Services. Termination of your Prepped account includes (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in Prepped’s sole discretion and that Prepped shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.
Member Conduct
You agree to not use the Service to:
- Upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
- Stalk or otherwise harass an Prepped employee or another user;
- Impersonate any person or entity, including, but not limited to, a Prepped representative, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Intentionally or unintentionally violate any applicable local, state, national or international law, and any regulations having the force of law; and/or
- Collect or store personal data about other users in connection with the prohibited conduct and activities set forth in the paragraphs above.
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service (including your Prepped username), use of the Service, or access to the Service. You agree that your Prepped account is non-transferable.
Indemnity
You agree to indemnify and hold Prepped and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.
Supplemental Programs
Prepped offers a test-related tutoring consultation to purchasers and subscribers of Prepped. Consultations are a supplemental offering and must be arranged independently of the materials-purchase process. The Company’s failure to provide a consultation in situations including, but not limited to, too-short notice, lack of tutor availability, or lack of your availability, does not constitute grounds for refund of payment for preparation materials.
General Information
The Terms of Service constitutes the entire agreement between you and Prepped and governs your use of the Service, superseding any prior agreements between you and Prepped with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Prepped services, affiliate services, third-party content or third-party software.
Payments
Payments for purchases and subscriptions can be made via PayPal or credit card.
